【摘要】 交通事故责任认定具备具体行政行为的法律特征,属于具体行政行为的范畴。因此,从法理上来讲当然具有行政可诉性。研究道路交通事故责任认定的可诉讼,关系到人民生命财产安全的合法保护和执法公正的问题。文章在论述我国交通事故责任认定的现状及弊端的基础上,提出了交通事故当事人的权利救助对策,即行政诉讼。更多还原

【Abstract】 The traffic accident’s responsibility confirmation has the characteristics of administrative action,belongs to the category of the specific administrative act.Therefore,from the angle of legal theory,it has administrative suability.The study of road traffic accident’s responsibility confirmation can be related to the legal protection of people’s life and property safety and fair law enforcement problem.The article discusses the responsibility confirmation of road traffic accident based on present situation and the disadvantages,then puts forward the rights rescue measures,that is administrative litigation.更多还原
