【摘要】 作为非监禁刑罚执行方式的社区矫正制度的立法化,表明我国刑罚及其执行方式开始步入人道化、轻缓化、国际化、节俭化、个别化、教育化与社会化的发展趋势。刑罚的人道化禁止不人道的刑罚方法,刑罚的轻缓化要求刑罚整体趋向轻缓、宽和化,刑罚的国际化要求与国际刑罚轻缓化趋势接轨,刑罚的节俭化要求在刑罚有益的前提下最低限度地降低刑罚成本,刑罚的个别化包括刑罚制度上的个别化、裁量上的个别化和处遇上的个别化,刑罚的教育化旨在通过循循善诱或潜移默化的教育,使之思想和行为良性化,刑罚的社会化旨在通过开放的非监禁方式,在多方主体的广泛参与下实现现代刑罚惩罚与预防的双赢目的。更多还原

【Abstract】 The legislation of community correction,which is a non-imprisonment penalty,identifies the trend of humanitarianism,leniency,internationazation,thrifty,individualization,educationization and socialization of penalty.The penalty humanitarianism forbids inhumanitarial penalty,the leniency of penalty requires overall leniency of punishment,the internationazation of penalty requires compatablity with international standards,the thrifty of penalty requires decrease of penalty cost,the individualization of penalty requires individualization of penal system,discretion and treatment,the educationization of penalty aims to make thought and behaviour benign,and the socialization of penalty aims to realize the win-win target of punishment and prevention through open style non-imprisonment with wide participation of various parties.更多还原
