【摘要】 刑事被害人国家救助制度旨在对遭受严重暴力犯罪的被害人及其家属生活上的扶困助贫。文章对刑事被害人救助的理论基础进行了论述与评析。我国宜以社会福利说为理论基础,兼采其他学说的合理内核,紧密结合中国实情,借鉴国外先进经验,对刑事被害人国家救助的条件、对象、范围、资金来源、救助机构等问题做出规定。更多还原

【Abstract】 Criminal victims’ state aid system aims to provide assistance for victims and their families suffering from severe violent crimes and living in poverty.This paper elucidates the theoretical basis of criminal victims’ aid.It is proper for our country to adopt the version of social welfare as the theoretical basis with the rational cores of other theories as supplements,to learn from advanced foreign experience in combination with Chinese characteristics,and to prescribe such issues as the conditions,object,range,funding sources,relief agencies of criminal victims’ state aid.更多还原
