【Abstract】 The theoretical basis of the effective performance of power of proposal for measurement of penalty is the theories of judiciary separation and procedural process.There are two misunderstandings of the standards of the effective performance of power of proposal for measurement: equating the performance standards of trial supervision power with the one of the power of proposal for measurement of penalty;equating the effective performance standards of conviction request right in public suit rights with the power of request for measurement of penalty.It’s necessary to define the principle of the effective performance standards,the macro-standards and micro-standards of the effective performance of power of proposal for measurement of penalty.更多还原
