【Abstract】 Continuous contracts ( Dauerschuldverhltnisse) are contracts of which the overall payment canonly be fixed according to the extension of the time. It is a dynamic processing contract with the properties ofrelational contract and incomplete contract,in nature,continuous contracts are uncertain contracts. The formsof continuous contract and discrete contract are of primary and secondary structure in modern contract law system. The legislative strategy of "continuous contract in the form of discrete contract" adopted in the contractlaw accords with its internal logic and fundamental idea. Based on the open property of "model contract category" ,continuous contract is included in the contract law system of which discrete contract is in the leadingposition.更多还原
