【摘要】 当医疗机构对患者构成医疗损害而患者向医疗机构请求赔偿时,社保机构已为患者支付的医疗费用应如何处置,我国现行法律对此未作出明确规定,实务中多见医疗机构既不赔付给患者及家属,也不赔付给社保机构。本文认为医疗机构构成医疗损害应按医疗侵权责任比例偿付社保已为患者支付的医疗费用,我国医疗社会保险相关立法则应就此作出明确规定。更多还原

【Abstract】 The current laws in our country haven’t prescribed how to deal with the fees that have been prepaid by social insurance when patients demand a compensation for the impairment done the medical institutes.In real practice,it is common that they pay for neither patients and their relatives nor social insurance institutes.Medical institutes should pay social insurance back the prepaid treatment fees for patients on the proportion of their responsibility,which should be prescribed by concerned legislation in medical social insurance.更多还原
