【摘要】 森林资源广泛的经济价值使国内外关于林权界定的研究大多集中在经济意义的产权上,而林业资源无法替代的生态功能决定了它有着不可忽视的环境产权特征,两种产权范式具有不同的目标、追求与结果。如何使双重产权并行不悖,是中国林权改革的重大问题。为此,通过对双重属性产权不同的人格化代表、不同的效率目标及不同的功能定位分析,探讨了如何通过制度构建将林权经营放在共同遵守的经济秩序与社会规则中,以实现双重产权的相容互盈。更多还原

【Abstract】 Forest resources have a wide range of economic values,so studies on the definition of the forestry right at home and abroad center mainly on property rights in the economic sense.Nevertheless,the irreplaceable ecological function of forestry resources decides that it has the characteristics of the environmental property right not to be ignored,and paradigms of both property rights have different goals,pursuits and results.How to make the duel property rights run parallel is a major issue in the forest property right reform.Therefore,from the analysis of different personification representatives,efficiency objectives and function orientations of the dual nature of property right,this paper discusses how to set up a system that will place the forest property right operation into the economic order and social rules jointly observed in order to make the dual property rights compatible with each other with the two-win feature.更多还原
