【摘要】 研究慈善法人的公、私法属性具有重要的理论和实践意义。从其发轫、发展到今天,慈善法人的法律属性发生了从公法人向私法人的巨大转化。如今在国外,国家权力已经退出慈善部门,其当属私法范畴。然我国的慈善法人在各方面均表现出强烈的公法人倾向。有必要改变现行的纵向行政部门立法模式,以民事法人制度为起点构筑横向的私法模式。更多还原
