【摘要】 作为体育领域的特殊仲裁制度,国际体育仲裁院的仲裁机制在很多方面已经脱离了传统商事仲裁的一般属性,并越来越多地表现出一些类似于司法机制的特征。这些特征在奥运会特别仲裁中得到了集中体现,尤其在2008年第29届奥运会上得到了进一步发展。这一趋势对于奥运会法律制度乃至国际体育法制的发展具有积极意义,但由于其对传统仲裁制度某些根本属性的颠覆和背离,也可能会引发一些问题。同时,这种发展趋势也会对我国体育纠纷解决机制以及整个体育体制的发展产生相应影响。更多还原

【Abstract】 The mechanism of CAS is a special arbitration system in sports area which has broken far away from the fundamentality of traditional commercial arbitration,and has been developing more and more features which seems close to the judicial system.These features have been embodied in the CAS Ad Hoc Division of Olympic Games,especially in the 2008 Beijing Olympic Games.This tendency would play a positive rose in developing the legal system of Olympic Games and international sports,but it might also initiate some problems for its far departure from the fundamentality of traditional arbitration.While the tendency would also give a valuable effect to the promotion of sports dispute settlement mechanism and sports management system in China.更多还原
