【摘要】 由于城镇商品房房价的不断攀升和城乡土地二元制政策等多种原因催生了所谓"小产权房"问题。"小产权房"的出现和交易量的扩大其实具有法理基础和一定的现实合理性、不应简单处理、一律叫停。应当加快农村集体用地使用权合理流转的立法,进一步完善城乡土地管理法律制度,才能正确妥善解决好"小产权房"问题。更多还原

【Abstract】 Due to the rising price of commercial houses in cities and towns,land binary policies between urban and rural areas,and some other reasons,the so-called "the small-property-right houses" come into being.As a matter of fact,the emerging and expansion of transactions of the small property right houses have legal foundations and certain realistic rationalities.Therefore it should not be treated in a rough way or be stopped.Legal systems should be set up in a faster pace on proper circulation of rural collective lands to further improve the laws on management of both urban and rural lands for the purpose of properly solving the problem of "small-property-right houses".更多还原
