【摘要】 改造哈特的法理论,并建立起与法社会学共享的描述社会学一直是不少人的愿望。努力的可能方式之一,是在哈特规则体系中植入取消规则,并把原本规整的二阶规则扩展为具有社会生态关系的规则丛。虽然改造后的规则理论已不是纯粹意义上的实证主义法理论,但它没有破坏哈特规则理论原有的内部基本关系,并能够整合法社会学的既有概念资源,实现对中国法制现实的立面解释。更多还原

【Abstract】 Some legal sociologists have been trying to reform Hart’s legal theory and build up a discipline of descriptive sociology which may benefit both legal positivism and legal sociology. To achieve this purpose, one possible approach is to graft rules of abolishment onto Hart’s legal theory and expand the orderly second-order rules into the cluster of rules to include social-ecological relations. Though not exactly of the nature of legal positivism in its real sense any more, the transformed system retains the basic constructs of Hart’s legal theory, and it can integrate the conceptual resources of legal sociology as well as comprehensively interpret the status quo of China’s legal society.更多还原
