论医疗损害举证责任分配
Allocation of the Burden of Proof in Medical Malpractice
【摘要】 探讨医疗损害实行举证责任倒置的渊源和价值,并对《中华人民共和国侵权责任法》(以下简称《侵权责任法》)中医疗损害举证责任进行分析,该法明确了医患双方承担的举证责任。
【Abstract】 We discuss the origin and value of the inversion of the burden of proof in medical malpractice,and analyz the burden of proof in medical malpractice in view of the Tort Liability Law.The new law clarifies the burden of proof between hospitals and patients.
