【摘要】 预期违约制度和减损规则的合理性在于它们能够促进经济效率。我国合同法规定有预期违约制度和减损规则,但是这二者之间的关系却不甚明了,这尤其表现在预期违约情形下减损义务产生的时间问题上。应该遵循效率进路,确认预期违约情形下的减损义务产生的时间起始于对方确定的履行拒绝。当对方的履行拒绝的信息模棱两可时,可以借助于请求提供履约保障的方式予以确认。更多还原
