【摘要】 行政规范性文件在行政管理活动中具有执行性功能和创制性功能,是行政主体进行政治、经济、文化和社会管理的工具性手段,但在实践中却异化为其巧取豪夺的一种道具。在依法行政背景下,其原因表现为畸形政绩观、依法行政能力差、规制不足、救济乏力等,因此需要从理念的重新定位、内容和程序上的防范以及救济制度的完善等方面纠正其异化现象。更多还原

【Abstract】 Administrative normative documents perform the executive and creative function in the administrative activities.As the instrumental means of the political,economical,cultural and social management used by administrative subject,the administrative normative documents,however,has been dissimilated as a tool of dispossession in practice.In the context of the administration according to law,this kind of alienation results in abnormal performance concept,poor administrative ability,inadequate regulation and relief,etc.many aspects require correcting,such as relocation of the idea,strick precaution on content and procedure and relieve the completion of the system and so on.更多还原
