【摘要】 对林权主体和林权的物权属性这两个林权制度改革中的基本问题进行分析。首先,以林地的归属为标准将林权主体划分为林地所有者和林地使用者两个不同类型,并对二者间的关系进行阐述;其次,将狭义的林权与土地承包经营权进行比较,分析二者间的相同与不同之处,进而对林权的占有、使用、收益、处分这4项用益物权权能进行分析,提出林权人合理的权利和义务。更多还原

【Abstract】 The subject and the legal nature of forest tenure which is the basic problem of collective forest tenure reform was analyzed in this paper.The agents of forest tenure were first divided into two types—the owners and the users of woodland according to the woodland tenures,and their relationship was explained.Secondly,through the comparison between forest tenure and rural land contracted management right,the authors pointed out their differences and similarities.Finally,four rights of functions of forest tenure were treated respectively.更多还原
