【摘要】 在民办高校的治理中,存在着没有硬法形式但有实际约束力的软法规则。兴办民办高校是政府发展高等教育之行政任务民营化的一种方式,民营化后确保行政任务的实现基于行政主体"国家担保责任"的履行。政府应运用民营化以及国家担保责任方面的软法规则,以给付行政的姿态引导民办高校良性发展。允许投资者取得合理回报的软法规则,将释放民办高校的办学活力。正确认识正在发挥作用的软法规则对于完善硬法以及发展民办高等教育具有重要意义。更多还原

【Abstract】 In the governance of private colleges,there is no hard law form but the soft law with actual binding force.Setting up private universities is a way to privatization of administrative tasks when developing higher education.The realization of administrative tasks depends on the performing administrative subject’s State Guarantee Liability.Therefore,the government should utilizes soft law of privatization and state guarantee liability to guide the colleges’ sound development with administrative supply,as well as allow investors to obtain reasonable repayment which will release the energy of private college.Correct Understanding of soft law which is taking effect of significance to perfect hard law and develop private higher education.更多还原
