【摘要】 在我国,由于农村人情浓厚,厌讼心理根深蒂固,农村纠纷解决的司法机制尚未建立完善,"私了"现象频现。有针对性地在农村犯罪的处理中开展刑事和解,对农村犯罪"私了"给予相应的法律规制和引导,有利于将农村犯罪中广泛存在的"私了"阳光化,既可以更好地修复被犯罪破坏的社会关系,符合农村人情社会的特点,又可以以较低的成本获得有约束力的协议。农村犯罪刑事和解是贯彻宽严相济刑事政策的要求,也是实现农村法治的重要保障,无论对于加害人、被害人,还是社会,都是有利的。更多还原

【Abstract】 In our country,people attach importance to worldly wisdom,and the view of hating suits is deep-rooted,while the judicial system of solving disputes in rural area has not been set up and perfected,so the cases of "settle out of court" can be found frequently.To carry out criminal reconciliation when dealing with rural crime targetly brings approriate regulations and guidance,and is helpful to exposure the cases "settle out of court",which cannot only repair social relations damaged by crime,being in line with the rural characteristic,but also get the bound agreements at a lower cost.Criminal reconciliation of Rural Crime is the requirment of the criminal policy both with the characteristics of being loosen and strict,and the important safeguard of realizing rural constitutionality,which benefits both the criminal,victims and society.更多还原
