【摘要】 "利用影响力受贿罪"是我国刑法新增加的罪名。此罪的设立引起了是"新利剑"还是"免罪符"的争论。本文认为此罪严密了刑事法网,是打击职务犯罪的"新利剑",有利于更好的打击职务犯罪,指出此罪的关键在于正确适用,提出了执行此罪的一些宏观举措,以期正确发挥"利用影响力受贿罪"的打击功能。更多还原

【Abstract】 "Taking bribery by one’s influence" is a new accusation in new criminal law,which arouses the controversy of "a new sword"or "a punishment exemption certificate".the accusation strengthens the arm of the law.It is a new sword to crack down on crime by taking advantage of duty.The paper points out that the key to crack down on the crime depends on the proper application,and puts forward some macro-measures.更多还原
