【摘要】 夫妻共同债务是夫妻财产关系中的重要内容。夫妻共同债务能否清楚界定对于债权人与婚姻当事人合法利益的保护具有重大的意义。就夫妻共同债务而言,现实生活中一般存在两种损害他人利益的情形:一种是夫妻双方恶意串通损害债权人的利益,另一种是夫妻一方与第三人串通损害对方配偶的利益。防止这两种违法情形的发生,应实行夫妻共同债务的"双重推定规则"。更多还原

【Abstract】 The couples’ common debts is important issue in marital property relationship.Whether common debt can be characterized clearly,which is very important for the protection of creditors’ rights and interests.As to common debt,there are two circumstances of injuring others’ interests: the first is husband and wife colluding with each other to harm creditors;the second is one party of couples colluding with other people to injury the other party of couples.In order to prevent these two illegal circumstances,the author suggests that "the rule of double presumption " shall be adopted in the characterization of common debt.更多还原
