【摘要】 知识产权法律制度是当下世界通行的保护科学技术和文化艺术成果的重要法律制度。中国的法制化是在政府的推进下启动和进行的,政府对知识产权制度的认知程度直接决定知识产权制度的立法及实践。本文回顾了我国政府对药品知识产权制度的认知进路及在其影响下的立法进程,认为我国药品知识产权立法经历了3个时期:对药品知识产权不予保护时期,对药品知识产权承诺保护时期,对药品知识产权主动保护时期。迄今为止,我国对药品知识产权保护的条件已经成熟,将步入依靠药品知识产权保护促进制药产业发展时期。更多还原

【Abstract】 The legal system of intellectual properties is an important legal system that protects the accomplishment of science and technology as well as literature and art.Legal institution is implemented by the government in China.The legislation and practice of the legal system of intellectual properties are decided by government’s understanding level,this article recalls the understanding route and legislative progress of the legal system of pharmaceutical intellectual properties in China.The author thinks that the legislation of pharmaceutical intellectual properties has experienced three stages: the stage of refusing to protect the pharmaceutical intellectual properties;the stage of promising to protect the pharmaceutical intellectual properties;the stage of being conscious of protecting the pharmaceutical intellectual properties.The condition of protecting the pharmaceutical intellectual properties has matured so far,the government will promote the development of pharmaceutical industry by protecting the pharmaceutical intellectual properties.更多还原
