【摘要】 医疗纠纷作为一种社会冲突现象,是社会危机的反映;寻求其多元化解决途径,是当务之急。在建立和完善医疗纠纷预防与处理机制的问题上,地方立法可以发挥积极作用。浙江省政府已将医疗纠纷预防与处理立法列入了2009年计划项目。本文力求表达立法应当把握的基本精神、原则以及立法的重心,设计了完整的立法框架和建议草案,以期引起学界讨论,从而为政府制定该法做好充分的前期准备。更多还原

【Abstract】 Medical disputes,a manifestation of social conflict,is a mirror of people’s livelihood in our society,therefore it is urgent to find out diverse solutions.Local legislation can play an active role in establishing and improving the medical disputes’ preventing and treating mechanism.ZheJiang provincial government has listed it in 2009 planning projects.This paper sets its sight on the basic principles and the essence in legislation,designs an integrated framework and draft proposal for academic circles to discuss,and makes full early-stage preparations for the government to enact the law.更多还原
