【摘要】 我国结婚制度是婚姻制度的重要组成部分,2001年婚姻法(修正案)对1980年《婚姻法》有关结婚制度实质要件的基本内容没有作出修改,现随着时代的发展,已明显不适应新时期调整婚姻家庭关系的需要。我们应以制定我国《民法典》为契机,对禁止结婚的主体范围、老年人再婚权利的保护等问题作出具体规定,以全面完善我国的结婚法律制度。更多还原

【Abstract】 In China,marriage regulation is an important part of marriage system.In Marriage Law(Revised Version) of 2001,no a-mendment has been done to basic content concerning substantive elements of marriage regulation in Marriage Law of 1980.With the development of the times,it cannot meet the needs of adjusting relationship of marriage and family in the new era.Upon the oppor-tunity of making China’s Civil Code,specific regulations must be laid down on the range of subjects forbidden to get married and the right protection of remarriage of old people,thus perfecting legal system of marriage in China.更多还原
