【摘要】 虽然当下的法律、法规等对规范性文件的监控规定了不同的方式,如行政复议、权力监督、行政监督等,而且《行政诉讼法》修改建议稿已把司法审查作为监督规范性文件的最后屏障,但这些具体的方式对乡镇规范性文件的控制却不是个个有效。从对W镇政府2006年发放的73件红头文件的逐项分析来看,规范性文件的范围远远小于红头文件。在各种监控方式中,行政监督是目前监控乡镇规范性文件的最有效方式。更多还原

【Abstract】 Although the present laws and regulations have provided for different ways to supervise and control regulative documents,such as administrative reconsideration,legislative supervision,administrative supervision,etc,as well as judicial review which has already been deemed as the final weapon to supervise regulative documents in the proposal of amendment to Administrative Procedure Law.Analyzing each provision of the 73 red-head documents issued by the W town government,the scope of regulative documents is far smaller then that of red-head documents.Among these ways of control,so far administrative oversight is the most effective method to supervise and control village-and-town-level regulative documents.更多还原
