【摘要】 我国刑法运用选择性罪名的立法技术,将运输毒品罪与走私、贩卖、制造毒品行为相并立。但是,相关条文对运输毒品罪基本特征的描述采取了简单罪状的立法形式,法条粗简,无法与实践中纷繁芜杂的运输毒品行为有效对接,在实践中导致了诸多混乱。因此,对运输毒品罪的立法与司法、理论与实践相关问题进行系统化研究有助于提升治理毒品犯罪的整体成效。更多还原

【Abstract】 Alternative charge is applied in our Criminal Law,thus the crime of drug trafficking includes smuggling,trafficking,transporting and making drugs.But the terms concerned are too simple to cover the complicated situations in reality,which causes the confusion in practice.This study which focuses on the legislative and judicial problems of transporting drugs will contribute to the prevention and control of drug crime.更多还原
