【摘要】 单位与自然人作为犯罪两大主体,都应该存在自首问题。单位自首的主体包括单位犯罪参与者、单位内部监管机构。对单位直接责任人员及其授权人员一般自首的认定与处罚,应当充分考虑单位犯罪的整体性、主体二元性、处罚双重性以及各犯罪成员的共犯性质等,并兼顾不同单位成员在单位犯罪中的作用和地位,加以综合分析判断。非单位直接责任人员及其授权人员的单位成员代表单位自首,只成立单位自首,个人不能成立自首。更多还原
