【摘要】 司法资源的稀缺性决定了司法实践中对资源的配置与利用必须作出合理的安排。长期以来,我们在资源的配置过程中过分追求实质正义的结果而忽视了资源配置的哲学依据,造成法律资源配置与分享的失衡,从而使得法律的公正性受到不同程度的损害。在司法资源的配置过程中兼顾各方利益并制止各方为了私利对司法资源进行毁灭性的争夺,保障诉讼各方在司法资源的分享上获得公平对待,降低诉讼成本,惜时诉讼,正是分配正义哲学在司法领域的价值诉求目标。更多还原

【Abstract】 The judicial resources’ scarcity had decided in the judicial practice must make the reasonable arrangement to the resources disposition and the use,the unreasonable resources deployment and the share principle are for the purpose in pursuing the substantive just result excessively,which neglected the philosophy basis as the resources deployment.The unbalanced condition of law resources distribution and share causees the varying degree harm to legal just.Gives dual attention to all quarters benefit in the judicial resources’ allocation process and stops all quarters for the personal gain to plunder judicial resources destructively,which is the value goal of philosophy of distributive justice in the judicial field.更多还原
