【摘要】 非法行为取得的被告人供述的证据能力如何确定,是我国刑事诉讼证据立法及理论研究的空白。构建我国的非法证据排除规则的核心问题在于通过何种程序确定非法取得的被告人供述的证据能力。在判断非法供述的证据能力过程中,应当赋予司法裁判者自由裁量权,结合案情具体判断,在"有效打击犯罪"与"保障被告人人权"两种价值之间进行平衡。更多还原

【Abstract】 How to determine the confessional evidences which are obtained by illegal action is still an legislative vacancy in the criminal procedure law in China.The key problem on how to set the exclusionary rule of confession illegally obtained in China is the procedure of determining the credibility.In the course of estimating whether the evidences are obtained by legal way,the judges should have discretion,and then they could get balance between "attacking the crimes effectively" and "protecting the defendants’ human rights".更多还原
