【摘要】 宪政主义和民主主义两大政治理论具有共同的逻辑起点——人的尊严和自由权利。为了捍卫它,民主理论高扬人民大众的智慧和道德从而求助于多数决定规则;而宪政理论既不敢盲目信奉个人的德行,也不敢完全相信多数决定规则,从而主张用基本宪政价值与事前制定的公共规则来限制政府行为。它们内在的融通性和各自的局限性,促使它们协同作战从而构建了人类迄今较理想的政制,即法治模式下的宪政民主制。更多还原

【Abstract】 Constitutionalism and democracy,the two political theories,have the common logical beginning—person’s dignity and the free rights.In order to guard it,the democratic theory raises masses’ wisdom and the morals and seeks help from the rule that decision is made by the most people.But the constitutional theory do not blindly believe in individual morals,also do not completely believe in the rule that decision is made by the most people,but claim that the public rules should be made beforehand to limit the government behavior.Because they have intrinsic conjunction and respective flaw,these urge them to combine to construct the most ideal political system up to the present,namely constitutional democratic system under the pattern of rule of law.更多还原
