【摘要】 从家庭功能的角度来看,非婚同居完全可以承担婚姻家庭的相互扶助、稳定的性结合及生育子女等基本功能。同时,相比于婚姻,非婚同居保留了足够的家庭自治空间,为越来越多的人所践行。现代社会家庭模式和生活方式多元化趋势已不可扭转,家庭法应当构建多层次的家庭规制体系,应当本着保护弱势,稳定生活共同体的主旨,将非婚同居纳入家庭法的调整范围。同时立法仍应肯定婚姻的社会主导地位,在非婚同居制度的设计方面采用与婚姻区别对待、分别调整的原则,使严格的婚姻和松散的非婚同居互易互补,维护人类的进步与秩序。更多还原

【Abstract】 The emergence of living on tally is the result of social history and the changes of marriage and family. Seen from the perspective of family function,living on tally is entirely possible to achieve the basic functions,such as the mutual commitment of marriage and family,stable sexual link and human reproduction.At the same time, living on tally retained sufficient autonomy spaces at home,which has been put into practice by more and more people.In the modern society,the diversification of family patterns and lifestyles can not be reversed,and Family Law should establish a multi-level family regulation system,bringing living on tally into its main object of concern, for the purpose of protecting the weak and maintaining the stability of the living community,instead of focusing on regulating the family relations within the marriage scope.Meanwhile,legislation should ensure the social dominant position of legal marriage;and the design of legal system concerning living on tally,on the other hand,legislation should be addressed differently and regulated separately.Thus the completeness of law can be maintained with the strict legal marriage and the loose living on tally mutually complementing,achieving the goal of sustained human progress and public order.更多还原
