【摘要】 近年来,国际贸易中知识产权产品的平行进口现象日益凸现。有关专利权权利耗尽及其产品平行进口问题,世界各国的立法和司法实践差异很大,理论界也就此问题探讨争议多年。简介了专利产品平行进口的三种基本政策,对支持或反对专利产品平行进口的学者们所持的经济理论进行了对比剖析,以期为发展中国家制定更加务实有效的平行进口政策提供理论分析参考。更多还原

【Abstract】 In recent years, parallel imports of intellectual property goods in international trade have become increasingly prominent. As far as the exhaustion of patent rights and parallel imports are concerned, there is much divergence in the international legislation and jurisdiction. The field of theory has probed this issue for many years. This paper introduces three basic parallel imports policies of patented goods and contrasts the e-conomic theories different policies rely on in the hope of providing theoretical analysis reference for develop-ing countries to formulate pragmatic and effective parallel imports policies.更多还原
