【摘要】 以防艾为目的提出来的卖淫合法化其实并不是防艾的良方,本文从生命伦理学视角对卖淫合法化观点和理由中所存在的认识误区一一进行了澄清,并指出:卖淫合法化并不能起到改善妓女基本权益保障状况和阻断艾滋病性传播途径的作用;不能因现行"扫黄"政策的不合理性就否定"扫黄"本身;卖淫合法化将改变国家在此问题上的道德、法律立场,将导致嫖娼合法化和社会的整体道德滑坡等。进而提出我们的主张:我国应坚持把卖淫嫖娼视为社会丑恶现象的道德、法律立场,不能因为某些预期的功利考虑(实际并不一定见效)而采纳卖淫合法化的主张;在处罚卖淫、嫖娼违法行为时,根据我国国情,应该区分二者不同的道德法律责任,相对加重对嫖娼行为的处罚,注重对卖淫者的生计能力培训和行为疏导。更多还原

【Abstract】 To prevent AIDS,it was proposed that the prostitution should be legalized.But this would not be a best choice.From the bio-ethical perspective,this paper tries to clarify some misunderstandings in the views and reasons of legalizing prostitution.Firstly,the legalization of prostitution can not improve women’s basic rights and interests.Nor can it block the transmission of AIDS.Secondly,we can’t deny the anti-pornography campaign for the sake of the irrationality of current anti-pornography policy.Thirdly,the legalization of prostitution means the legalization of buying sex.What is worse,this will lead to the overall moral decline in China.Therefore,we strongly advocate that we should hold the moral and legal position that prostitution is social vices and will never legalize it from certain presumed utilitarian considerations(actually they do not work at all).In penalize the acts of buying sex and whoring,we should distinguish their respectively different moral and legal responsibilities.We should give more serious penalty to the sex buyers and intensify the education and guidance in improving the livelihood of whores.更多还原
