【摘要】 目前,学生体育伤害事故的赔偿中存在法律归责原则不全面、赔偿资金不足、到位不及时等问题,而学生无力独自承受巨额经济损失是学校和学生之间发生法律纠纷的主要原因。根据经验和保险的分担危险、补偿损失功能,依托商业保险实现赔偿责任社会化是解决赔偿纠纷的最佳途径。建议:完善相关法律、建立学生体育伤害保障机制。更多还原

【Abstract】 At present,there are some questions in the compensation of student sports injuries,such as the principle of legal liability is not comprehensive enough,compensation for lack of funds and not in place in time and so on,and students unable to bear the huge economic losses alone is the main reason of legal disputes between school and students.According to the experience and the function of insurance such as the risk-sharing and compensation for loss,relying on commercial insurance to achieve the socialization of liability is the best way to resolve compensation disputes.It is suggested that we should improve the relevant laws and build students sports injuries protection.更多还原
