【摘要】 民事行为能力制度的功能是随着民事主体制度的历史发展逐步显现的。历史条件的变化造成了权利能力制度的虚化和功能变换,行为能力制度成为现代民法主体制度的核心。在现代民法主体制度中,民事行为能力制度界定主体属性功能日益强化,控制行为效力功能也逐步扩张。在民法典中,民事行为能力制度应当采取总分则结合的体例安排,应当并存于财产法和人身法部分,应该通过一般条款和其他原则性规定为民事行为能力制度功能的发挥留有余地。民事行为能力制度的体系价值首先在于其在民事能力构造中的独特作用,其次应该在民法理论中合理建构法律行为能力与民事行为能力的理论疆域。更多还原
