【摘要】 在中国传统政治文化和道德文化中,我们可以挖掘很多关于法与伦理关系的思想。由于中国特定的历史文化条件,中国古代法的伦理化倾向特别突出,即历代统治者不仅大力鼓励、倡导儒家的忠孝节义的伦理观,并且大力予以实践,将儒家的道德观纳入到立法、司法活动中,使法律成为贯彻封建地主阶级正统伦理思想的武器及其附庸。但是,到了宋代,特别是王安石变法时期,这种情形有所改变,即王安石试图以某种制度/法度来改变政治陋习和社会固有伦理观念,以其特有的政治治理观念重新诠释了法与伦理的关系,并付诸实践。更多还原

【Abstract】 In Chinese tradition politics culture and moral culture,there is much idea about law-ethics.In the Chinese ancient times,law being transformed to ethics is universal.The law becomes the weapon and the dependency for implementation feudal landlord social class legitimate ethics thought.But,in Song Dynasty,this situation changed.Wang Anshi attempted to change the political vulgar customs and the social inherent ethics idea by some system or law.He has annotated the relations between law and ethics by its unique political government idea and put it to practice.更多还原
