【摘要】 纵观财产支配权之演进史,其中一条清晰脉络是无体物支配权的出现与发展突破了财产支配权的单一结构。从罗马法到日耳曼法,以及我国的奴隶制法和封建制法,有体物是财产支配权的唯一客体。近代以来,财产支配权的客体范围大为扩张,一种不同于有体物支配权的无体物支配权应运而生并迅猛发展。20世纪以来,无体物支配权在传统知识产权基础上剧烈变革,客体范围不断扩展,乃至非知识产品无体物。无体物支配权地位日益重要,更有取代土地、房屋等传统财产地位而成为社会主要财富形态之势。更多还原

【Abstract】 Throughout the history of evolution of the right of property dominion,we can see clearly the emerging of dominion over the intangible breakthrough the sole structure of the right of property dominion.From Roman law to Germanic law,both slavery law and feudal law in China,tangible is the sole object of the right of property dominion.From the middle 19th century,the object of the right of property dominion expand largely,dominion over the intangible rised as a reflection of the times and developed very quickly.From the 20th century,dominion over the intangible changes greatly on the basis of traditional intellectual property,the object scope of the right of property dominion expand continuously,besides intangible of non knowledge product.The status of dominion over the intangible becomes increasingly important.更多还原
