【摘要】 随着经济社会日新月异的变化,商事公示制度的适用效率在商法实践层面显示出极大的生命力。运用法律条款分析与价值分析相结合的方法来审视,我国商事公示法律制度在立法、司法、执法、守法等各个操作层面上都表现出一定的问题和缺陷,严重影响了商事公示制度的适用效率。只有对法的价值给予应有的关注,不断修正法律规范本身的逻辑自足,才能引导商法不断更新,以适应经济社会发展的需要。提高我国商事公示制度适用效率的关键途径,在于确立正确的法律价值导向和适当利用内生性法律理论。更多还原
