【摘要】 "三农"问题的核心是农民问题,本文认为农民问题的本质是农民权益问题,而农民权益问题的实质是农民的人权问题。2004年宪法修正案将"尊重和保障人权"纳入国家的根本大法,为农民权益保障提供了宪法依据。尊重和保护农民权益既符合人权入宪的价值取向,亦是构建社会主义和谐社会的题中应有之义。保护农民权益,构建和谐社会,对党的执政能力和政府管理水平提出了新的时代要求。从现行的立法状况来看,我国的农民权益遭遇一定程度的漠视和侵犯。正视农民权益缺失的现状,探寻其原因,并采取行之有效的对策措施乃是当务之急。更多还原

【Abstract】 The core of problems concerning farmer,agriculture and rural area is the farmers;the essence of the farmer problem is the rights and interests of farmers.2004’s Constitutional amendment added the item of respecting and protecting farmers’ rights and interests into Chinese basic law.This paper provides the constitutional evidence for protecting farmers’ rights and interests.Respecting and protecting farmers’ rights and interests not only matches the value orientation of putting the human rights into the Constitution,but also is the intrinsic content of establishing a harmonious socialist society.Both the protection of farmers’ rights and interests and the establishment of a harmonious society require the executive power of our Party and the administrative level of our government to meet the need of the newera.from the current legislation,the rights and interests of farmers are to some extent ignored and offended,so it is urgent to pay great attention to the loss of farmers’ rights and interests and take effective measures.更多还原
