【摘要】 在我国目前的法律体系中,公立高等学校被定位为事业单位法人,但其行政主体法律地位并不明确,成为高等教育进一步发展的瓶颈。本文以界定公立高等学校行政主体法律地位为研究思路,在全面分析公立高等学校多重法律身份的基础上重点分析了公立高等学校的公务法人主体地位,从而实现以法律来规制公立高等学校的行政权力,构建具有法治精神的现代大学。更多还原

【Abstract】 In current jurisprudence,public universities are orientated as juridical persons of institutions,but the administrative legal status is not yet clearly difined,which prevents the further development of higher education.The thesis,taking defining the administrative subject legal status of public universities as an approach,analyzes the legal subject status based on their multiple legal status so as to build up modern universities with spirit of law by regulating the administrative power of public universities.更多还原
