【摘要】 WTO争端解决机制作为WTO法律体系的核心制度之一,自形成以来已获WTO成员的普遍认可,在国际贸易争端解决中发挥着重要的作用,也是今后各国解决国际贸易争端的主要途径。然而,我国由于入世时间不长,缺乏对WTO争端解决机制的深刻了解,在国际贸易争端处理中往往处于劣势地位。本文重在研究如何有效运用WTO争端解决机制,以保证我国国际经贸活动的顺利开展,从2008年7月18日"中国汽车零部件进口管理措施案"的终裁引入,虽肯定WTO争端解决机制所取得的巨大进步,但客观地指出我国运用该机制仍存在诸多问题,并针对不足探讨我国运用WTO争端解决机制的应对措施。更多还原

【Abstract】 As a WTO core system,the Dispute Settlement Mechanism(DSM) has been generally accepted among the WTO members since its emergence,for DSM has been playing an important role in dispute settlement and will be a main approach in international trade dispute settlement.However,due to its quite new membership,China has no deep understanding in DSM, which makes China at a disadvantage in trade dispute settlement.This paper focuses on how to effectively make use of DSM to ensure a smooth development of China’s international trade,which starts from the final decision of"China-Measure affecting imports of automobile parts,Reports of the Panel"on July 18,2008.Though it positively affirms the great progress in DSM,it objectively points out the existing problems in China to make use of DSM and further explores the counter measures for China to make use of DSM.更多还原
