【摘要】 研究目的:界定中国土地冲突的概念,归纳中国土地冲突的基本特征,剖析中国土地冲突的触发因素。研究方法:文献法,归纳法,演绎法,图表法。研究结论:在中国,土地冲突是单位或者个人围绕土地而发生的过激行动。土地冲突呈现与其他国家不尽相同的特征,合法的涉地行动可以引发土地冲突,非法的涉地行动也可以引发土地冲突;资源富裕地区可以发生土地冲突,资源稀缺地区也有土地冲突发生。在土地产权确定、土地所有权行使、土地使用、土地流转以及土地征用等环节,都存在众多可能触发土地冲突的因素。更多还原

【Abstract】 The purpose of this paper is to bring forward the concept of land conflicts in China,sum up their characters and analyze their trigger factors.Methods of documentation,induction,deduction and graphology were employed.The results indicate that the land conflicts in China are land-related ultra behaviors actualized by individuals or organizations.Compared to land conflicts in foreign countries,land conflicts in China present several unique characters,which may be caused by legal land-related behaviors or by illegal ones and which may occur both in regions with rich resources and in ones with poor resources.Many trigger factors of land conflicts in China exist in the fields such as the confirming of land property right,exertion of land ownership,land utilization,land circulation and land expropriation.更多还原
