【摘要】 知识产权海关保护是用行政手段对知识产权侵权产品的跨国交易进行规制,目的在于将侵权货物阻止在海关边境外,不让其进入一国或一单独关税区的商业流通,以免破坏正常的经济贸易秩序。我国已建立起相对完备的知识产权海关保护法律制度,但在具体制度方面存在不合理的方面,不利于保护相关权利人的利益。本文分析了我国知识产权海关保护法律制度的现状,对其不足进行探析,并提出了相应的法律完善措施。更多还原

【Abstract】 Customs protection of intellectual property rights refers to the regulations of cross-border trade related to intellectual property rights infringing goods through executive means.It is aimed at keeping infringing goods out of customs border and preventing them from entering a country or a separate customs territory in order to protect normal economic and trade orders.Our country has established a relatively perfect legal system of customs protection of intellectual property rights.However,there are imperfect aspects against protecting the interests of right holders concerned.This paper offers an examination of status quo of PRC customs protection of intellectual rights and an exploration of its shortcomings.Also,this paper brings forward corresponding means to improve the laws.更多还原
