【摘要】 土地征收是指为了公共利益的需要,由国家将集体土地强制性征归国有并按法定程序给予被征地集体或个人一定补偿的行为。对于我国集体土地征收的性质,目前学术界尚无一致的意见,对农村集体土地属"农民集体"的理解也存在诸多分歧,使土地征收在现实中产生许多矛盾,进而影响到征地补偿的标准、范围和分配。在我国目前的法律体系下,国家对农村集体土地征收的性质主要体现在主体缺位、国家主导、强制性、公益性、程序性和有偿性等方面。更多还原

【Abstract】 Land requisition,to a government,is the requirement of public interests.The government compulsorily collects collective land and compensates the individuals according to legal formalities.Until now,as to the nature of the land,there is no accordant opinions and quite a few differences exist in understanding that the collective land of countryside belongs to "the collectivity of farmers".This leads to many contradictions in land requisition and affects the criteria of the compensation,the range and the distribution as well.Under the current system of law,the nature of requisition to the collective land of countryside by the government reflects the absence of the main body,the government dominance,compulsion,public interests,procedure and compensation etc..更多还原
