【摘要】 以物权为切入口,确认物之归属的物权效率与物权公平的低层级统一,依靠物权二元结构的物权制度建立,使之转化为社会效率和社会公平趋向高层统一。物权制度的两个统一可应用于初次分配的对立统一。高层面统一是市场失灵时政府干预的作用,限制权利滥用,使权利社会化而导致收入分配均衡,这种均衡不是要素所有的配置结果。效率优先论是"权利本位"的价值体现,富人高效率的"蛋糕"不可能分给穷人。把握效率与公平在初次分配中的统一是缩小贫富差距、实现科学发展的杠杆点。更多还原
