【摘要】 澳大利亚家庭法院是世界上为数不多但却极富特色的法院之一。在处理家事法律问题上,它的一些理念、经验与做法正吸引着越来越多国家的目光。但在我国,学术界对其研究几乎接近空白。文章对澳家庭法院的特点包括其地位、管辖权与人事体系等问题作了一定的介绍和分析,并探讨了它的争端解决机制及实践效果。从中可以看出,无论是在处理管辖权先天不足上,还是在其他家事法律问题的解决上,家庭法院无不以人为本,并表现出特别的智慧与技巧。作为一个把当事人当作用户提供相应法律服务的专门法院,澳大利亚家庭法院的存在将会成为我国今后婚姻家庭立法与司法改革的一个坐标。更多还原

【Abstract】 The objective of this study is to make a necessary introduction to the characteristics of Australian family court,which is one of several courts in the world but has many interesting characteristics in dealing with family law matters.This paper not only examines its status,jurisdiction,personal structure and its dispute resolutions,but also explores its practice effects.The results indicate the major concern of Australia family court is to provide good services for users.The conclusions of this study indicate that more attentions should be paid to this helpful court,which would bring us some prospective directions in future judicial reform on the area of legislating family law.更多还原
