【摘要】 当下的政治话语对"国际现状"的概念不加界定就用来作为评判中国崛起的标尺,该术语最大的问题在于其高度情景化,且无确定的规范性内容。作者以国际法规范作为国际现状的规范内容。国际现状的核心是国际体系成员基于广泛承认与同意而做出的秩序安排。国际现状的具体表现为人类生活的空间法律秩序、物质基础法律秩序、国家行为和交往规范。通过从中国解决边界纠纷模式、加入国际制度的趋势、使用武力的环境与历史、接受习惯国际法、参与国际海洋法的立法、加入世界贸易组织(WTO)的进程分析来看,中国是在国际现状的框架范围内谋求国家利益的,而且还通过自身的国际法立法行为促进了国际现状和规范的形成。作者认为,在处理大国崛起或体系中的结构性变化时,应确保大国在国际立法过程中进行协调。更多还原

【Abstract】 Currently, the concept of "international status quo", without being defined, h as been often exploited in the political discourse to evaluate the rise of China . The biggest problem of this term is that it’s highly contextual and without a ny normative context. The author argues that international law should be regarde d as the normative content of "international status quo". The core of "intern ational status quo" is the arrangement of orders widely accepted and recognized by members of the international system, for example, the international spatial legal orders, the legal orders based on property and resources distributions, an d the interaction norms among states. In terms of China’s border dispute settle ment model, the trend in being accepted to international regimes, environment an d history of using force, acceptance of customary international law, participati on in the making of International Law of the Sea as well as its accession to the WTO, China has seeked its national interests within the framework of "interna tional status quo", and promoted the normative formation of "international sta tus quo" with its own legislations of international law. The author concludes t hat, as a big power rises or structural changes occurred in the international sy stem, coordination among big powers should be ensured in the process of internat ional legislation.更多还原
