【Abstract】 There are centuries-old tradition of case law in China,with experientialism,aristocrat inspirit and pragmatism being its cause.Statute system of continental law system is introduced into China blindly,as a result of double-lose of law and morality.To solve this difficult problem,we should bring form of law and culture tradition and philosophy of our times unified and introduce into case law;besides,we should enforce more control on judicial procedure.更多还原
