【Abstract】 Theorists have made a lot of explanations towards substantial legitimacy of administration by law by communist party except the design of form value of constitutionalism.The constitutionalism form of administration by law requires that the communist party set the idea of form value of constitutionalism,mainly transferring from policy leading to rule by law,driving procedural construction of administration by law forward,fulfilling the authority of communist party administrating.The communist party shall administrate through legitimate election procedure and realizing the separation system between the party and government.更多还原
