【摘要】 刑法介入劳动关系调整是社会发展到一定历史阶段的必然产物,是人类文明进步的标志。但劳动关系的何种范围能进入刑法的调整视野,既取决于某种劳动权利可能被侵害的程度,也在很大程度上与社会成员对劳动者的劳动尊重和认可程度有直接关系;我国已进入全面建设"小康社会"的阶段,尊重劳动,寻求人与自然和人与人的协调发展成为时代最强的声音;国家适当扩大刑法对劳动关系调整的范围和保护力度,是"以人为本"理念在执政上的具体表现,刑法理论研究给予必要关注,也彰显出‘严厉’的刑法在学术上的"人文关怀"。更多还原

【Abstract】 It is argued that the strengthened rule by law,a symbol of human civilization,is a social tendency as a coordination of the working relations.This,however,is linked to the respect and recognition to the labor by the workers to a large extent.In present Chinese well-being social progress,the respect of labor,harmony of human and nature are distinctively voiced.Hence the humanity in the stricter rule by law deserves more attention in the man-centered administration.更多还原
