【摘要】 目的探讨谢斌等编制的暴力作案刑事责任能力评定量表(CRRS-V)在广州地区责任能力3级评定中的应用。方法采用CRRS-V回顾性评定刑事责任能力鉴定392例,进一步检验该量表的信效度及其与原专家鉴定结论的一致性。结果CRRS-V的分半信度为0.9271,分量表与总量表之间、各条目与总量表之间及大部分条目之间的相关均有统计学意义(r为0.099~0.982,P<0.001)。据CRRS-V的参考划界分分组,无、限定和完全责任能力3组间及两两间总量表分的差异均具有统计学意义(P<0.001)。CRRS-V评定和专家鉴定两种责任能力分级方法的结果一致性较好(Kappa=0.702,P<0.05),以量表分级结果建立判别函数,无、限定、完全责任能力3级的回代判别正确率分别为93.8%、94.4%和91.0%。结论CRRS-V在广州地区使用的信效度良好,具有推广的应用价值。更多还原

【Abstract】 Objective To investigate the application of the criminal responsibility rating scale for violence(CRRS-V)developed by Xie Bin in the assessment of three-level criminal responsibility in Guangzhou. Methods Crimial responsibility of 392 cases were evaluated retrospectively with CRRS-V,of which reliability,validity and coherence to the judgment of the primary forensic experts were tested. Results The split-half reliability of CRRS-V was 0.9271.The inter-correlation of score on each item and each item’s correlation with the total score on the scale were all statistically significant (r=0.099～0.982,P<0.05).When the cases were graded into three groups(no,diminished and all responsibility group)according to reference division score of CRRS-V,the differnces of scores among three groups and within groups were significant(P<0.001).The coherence of the scale’s assessment and the experts’ judgment on the grade of responsibility was great(Kappa=0.702,P<0.05).Establishing discriminant function by the above three grading method of responsibility,classification results suggested that 93.8%,94.4% and 91.0% of the original groups were correct,respectively. Conclusion CRRS-V has good reliability and validity when used in Guangzhou.The results suggested that the scale can be used as the reference of the assessment of three-level criminal responsibility.更多还原
