【摘要】 依据城市拆迁中公共利益的内涵,对公共利益的界定进行了重新梳理和辨析,在此基础上,探讨城市拆迁中公共利益的特点、界定方法及解决路径,最后对城市拆迁公共利益实体界定的重复性问题和程序界定的虚化性问题提出了解决方案。应把城市拆迁中所积累的行之有效的宝贵经验以法律形式稳定下来,达到一个"公共利益的积累",使我国城市拆迁中的公共利益的界定越来越明晰化。更多还原

【Abstract】 According to the previous implication based on the content of public interest,in this paper it redefine and analyze the implication of the content of public interest.In the view of that,it analyze the characteristics of public interest,the method of its definition and the way to solve the problem in which the urban encountered.Finally,it find the methods to solve the repetitive issues about the definition and the preprogrammed problems of the urban demolition.we need to accumulate the precious experience that come from the practice in the real world,and we must fix it in the form of law in order to reach the goal of delimiting the public interest.更多还原
